Privacy Policy

In this privacy policy we inform you, in accordance with Art. 13 and 14 of the General Data Protection Regulation (GDPR), which personal data we process when you visit our website zahner.de and its subdomains (e.g. doc.zahner.de) or contact us in any other way, for what purposes we do so, and what rights you have.

1. Controller

2. General information on data processing

Legal bases. We only process personal data if there is a legal basis for doing so. The main legal bases are your consent (Art. 6(1)(a) GDPR), the performance of a contract or pre-contractual measures (point (b)), a legal obligation (point (c)) and our legitimate interests (point (f)). Storing information on your device or accessing it is additionally governed by Section 25 of the German Telecommunications Digital Services Data Protection Act (TDDDG). In the sections below, we state the specific legal basis in each case.

Retention period. We delete personal data as soon as the purpose of the processing no longer applies, unless statutory retention obligations require us to keep it. We retain commercial and business letters for six years, accounting vouchers for eight years, and books and annual financial statements for ten years (Section 257 of the German Commercial Code (HGB), Section 147 of the German Fiscal Code (AO)).

Recipients. We only pass on your data where this is stated in this privacy policy or where we are legally obliged to do so. Service providers that process data on our behalf are contractually bound by us in accordance with Art. 28 GDPR. We do not sell personal data.

Transfers to third countries. Data is only transferred to countries outside the EU/EEA where this is expressly described in this privacy policy. In these cases, the transfer is based on an adequacy decision of the European Commission (for the USA: the EU-U.S. Data Privacy Framework, Art. 45 GDPR) or on EU standard contractual clauses (Art. 46 GDPR).

No automated decision-making. We do not use automated decision-making, including profiling, within the meaning of Art. 22 GDPR.

3. Hosting and server log files

We run the website zahner.de on a virtual server provided by netcup GmbH, Emmy-Noether-Straße 10, 76131 Karlsruhe, Germany. Our subdomains such as doc.zahner.de and the download pages are hosted by webgo GmbH, Wendenstraße 8–12, 20097 Hamburg, Germany. Both providers' servers are located in Germany (netcup in Nuremberg, webgo in Hamburg). We have concluded a data processing agreement with both providers in accordance with Art. 28 GDPR.

Each time you access our website, the server automatically stores information that your browser transmits (server log files):

  • IP address
  • date and time of access
  • page or file accessed and amount of data transferred
  • referrer URL (the previously visited page)
  • browser type, browser version and operating system

This data is technically necessary to deliver the website, to ensure its stability and security and to fend off attacks. The legal basis is Art. 6(1)(f) GDPR; our legitimate interest lies in a secure and functional website. The log files are deleted after seven days. This data is not combined with other data sources.

Our website uses TLS encryption. You can recognise an encrypted connection by “https://” in your browser's address bar.

4. Cookies and consent management

Cookies are small text files that your browser stores on your device. We distinguish between two types:

Strictly necessary cookies are set without your consent because the website would not work without them. These are limited to one session cookie for the captcha and the forms and three cookies that store your cookie choice. We do not set any cookies of our own for analytics or advertising purposes. The legal basis is Section 25(2) no. 2 TDDDG; we base the subsequent data processing on Art. 6(1)(f) GDPR.

All other cookies and services are only loaded after you have given your consent via our cookie banner. For us, these are Google Maps in the category “Functionality cookies” and YouTube videos in the category “Targeting and advertising cookies” (see section 6). The legal basis is then Section 25(1) TDDDG in conjunction with Art. 6(1)(a) GDPR.

You can withdraw or change your consent at any time with effect for the future by clicking “Cookie Settings” at the bottom of the page. You can also delete or block cookies in your browser; in that case, the website may only work to a limited extent.

5. Contact, downloads and job applications

5.1 Contact form, email and phone

If you contact us via the contact form, by email or by phone, we process the information you provide (in the form: name, email address and your message; otherwise the data you give us) in order to respond to your enquiry. The legal basis is Art. 6(1)(b) GDPR if your enquiry relates to a contract or its initiation, and otherwise Art. 6(1)(f) GDPR; our legitimate interest lies in responding to enquiries. In the contact form, you can also voluntarily subscribe to our newsletter; section 7.3 applies to this.

The captcha in the form is generated on our own server; no data is transferred to third parties in the process. Our emails are handled by the servers of our email provider webgo GmbH, Wendenstraße 8–12, 20097 Hamburg, Germany, with whom we have concluded a data processing agreement; the servers are located in Germany.

We delete your enquiry once it has been fully dealt with and no statutory retention obligations apply (see section 2). If your enquiry leads to a business relationship, section 7.1 applies. If it comes from a country in which a distribution partner sells our products, section 7.2 applies.

5.2 Downloading application notes and documents

You can download our manuals, application notes and other documents without providing any personal data. In the download window, you can voluntarily subscribe to our newsletter; section 7.3 applies to this.

5.3 Job applications

We accept job applications by email or post. We process your application documents in order to decide whether to establish an employment relationship. The legal basis is Art. 6(1)(b) GDPR. Only the persons involved in the selection process have access to them. If you are not hired, we delete your documents six months after the end of the application process so that we can defend ourselves against any claims under the German General Equal Treatment Act (AGG) (Art. 6(1)(f) GDPR). We will only keep your documents longer for future vacancies with your consent.

6. Embedded services and links

6.1 YouTube videos

In our video library, we embed videos from YouTube. The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. The videos are only loaded once you have given your consent in the cookie banner. Only then is a connection to YouTube's servers established; in the process, YouTube receives, among other things, your IP address and information about which page you visited, and may set cookies on your device. If you are logged in to YouTube or Google, YouTube may associate your behaviour with your account.

The legal basis is your consent (Section 25(1) TDDDG, Art. 6(1)(a) GDPR), which you can withdraw at any time via the cookie settings. Data may be transferred to Google LLC in the USA; Google LLC is certified under the EU-U.S. Data Privacy Framework. Further information: https://policies.google.com/privacy

6.2 Google Maps

On our contact page, we use Google Maps to show a map of our distribution partners (provider: Google Ireland Limited, address as above). The map is only loaded once you have consented to the category “Functionality cookies” in the cookie banner or click “Show Map”. Google then receives, among other things, your IP address; a transfer to Google LLC in the USA is possible (EU-U.S. Data Privacy Framework). The legal basis is your consent (Section 25(1) TDDDG, Art. 6(1)(a) GDPR). You can withdraw consent given in the cookie banner at any time via the cookie settings. 6.3 Links to YouTube, LinkedIn and GitHub

Our website contains simple links to our profiles on YouTube and LinkedIn and to software downloads on GitHub. These are not embedded plug-ins: as long as you do not click on a link, no data is transferred to these providers. If you click on a link, the privacy policy of the respective provider applies.

7. Customers, business contacts and newsletter

7.1 Customers and business contacts

We process data of customers, prospective customers and business partners (e.g. name, company, position, contact details, order and invoice data) in order to prepare quotations, process orders, provide support and maintain the business relationship. The legal bases are Art. 6(1)(b) GDPR (contract and contract initiation), point (c) (legal obligations, e.g. retention for tax purposes) and point (f) (legitimate interest in maintaining business contacts). We store this data in our own customer management system on our own servers in Kronach; no external provider has access to it.

For deliveries abroad, we are legally obliged to screen customers against the EU sanctions lists and to submit export declarations (Art. 6(1)(c) GDPR). For shipping, we pass on the necessary delivery and contact details to parcel services and freight forwarders and, for exports, also to customs authorities.

7.2 Forwarding enquiries to distribution partners abroad

In many countries, a distribution partner sells our products exclusively. You can find out which distribution partner is responsible for your country on our contact page (https://zahner.de/contact#Ourdistributors) or by asking us. If you send us an enquiry from such a country by email or via the contact form, we forward it to the responsible distribution partner so that they can support you locally and in your language. In doing so, we transfer the data you have provided to us, in particular your name, company, contact details (email address, phone number, postal address) and the content of your enquiry. The distribution partner may then contact you directly. They process your data as an independent controller and will inform you about this when they first contact you.

The legal basis is Art. 6(1)(b) GDPR insofar as your enquiry is aimed at a contract or pre-contractual measures, and otherwise Art. 6(1)(f) GDPR; our legitimate interest lies in enabling prospective customers to receive support in their language and region.

If the distribution partner is located outside the EU/EEA, the transfer is based on an adequacy decision of the European Commission (Art. 45 GDPR) where one exists for that country, and otherwise on EU standard contractual clauses (Art. 46(2)(c) GDPR). You can request a copy of the standard contractual clauses at support@zahner.de. You can object to the forwarding at any time (see section 8).

7.3 Newsletter

We only send our newsletter with information on new products and application notes with your express consent (Art. 6(1)(a) GDPR). After subscribing, you will receive an email with a confirmation link; your subscription is only complete once you click on it (double opt-in). We store the time of your subscription and confirmation as well as the IP address used, so that we can prove your consent. The newsletter is sent via our email provider webgo GmbH (see section 5.1).

You can unsubscribe from the newsletter at any time via the unsubscribe link in every email or by email to support@zahner.de. We store your data for the newsletter until you unsubscribe. After you unsubscribe, we keep your email address on a block list so that you do not receive any further newsletters, and we keep the proof of your earlier consent for up to three years so that we can defend ourselves against claims (Art. 6(1)(f) GDPR).

8. Your rights

You have the following rights at any time:

  • access to the data we hold about you (Art. 15 GDPR)
  • rectification of inaccurate data (Art. 16 GDPR)
  • erasure of your data (Art. 17 GDPR)
  • restriction of processing (Art. 18 GDPR)
  • data portability in a commonly used, machine-readable format (Art. 20 GDPR)
  • withdrawal of any consent you have given, with effect for the future (Art. 7(3) GDPR); processing carried out before the withdrawal remains lawful

Right to object under Art. 21 GDPR

Where we process your data on the basis of legitimate interests (Art. 6(1)(f) GDPR), you can object at any time on grounds relating to your particular situation. We will then no longer process your data unless we can demonstrate compelling legitimate grounds that override your interests, or the processing serves the establishment, exercise or defence of legal claims.

If we process your data for direct marketing purposes, you can object to this processing at any time without giving reasons. We will then no longer use your data for this purpose.

To exercise your rights, an informal message to support@zahner.de or to our postal address is sufficient. This is free of charge for you.

You also have the right to lodge a complaint with a data protection supervisory authority (Art. 77 GDPR). The authority responsible for us is the Bavarian State Office for Data Protection Supervision (Bayerisches Landesamt für Datenschutzaufsicht, BayLDA), Promenade 18, 91522 Ansbach, Germany, https://www.lda.bayern.de.

9. Obligation to provide data, data security and changes

You are under no legal or contractual obligation to provide us with personal data. However, without the information marked as mandatory in the contact form or when subscribing to the newsletter, we cannot provide the respective service.

We protect your data with appropriate technical and organisational measures (Art. 32 GDPR), for example encrypted transmission, access restrictions and regular updates.

We update this privacy policy when our data processing or the legal situation changes. The version published on this page applies.
